CJP-led SC bench surprises critics through landmark verdict

SC larger bench, landmark verdict, CJP

A five-member larger bench of the apex court headed by Chief Justice Umar Ata Bandial has surprised the critics by giving a landmark judgment in the suo motu notice case against the ruling of National Assembly’s Deputy Speaker Qasim Khan Suri on the no-confidence motion.

A larger bench comprising Chief Justice Umar Ata Bandial, Justice Ijaz-ul-Ahsan, Justice Jamal Mandokhel, Justice Mazhar Alam Mian Khel and Justice Muneeb Akhtar has not only buried the ideology of necessity but also silenced the critics through a landmark verdict.

The larger bench has also proved the assumptions, predictions and misgivings of a large number of Pakistanis including senior journalists and political analysts wrong.

It is important to mention here that the SC’s larger bench did not have two senior judges including Justice Qazi Faiz Issa and Justice Mansoor Ali Shah who were considered anti-establishment judges and their absence from the bench led the people to make predictions and speculations which was proved wrong by the bench via its ruling.

When the hearing of the suo motu notice started in the Supreme Court, the opposition and some journalists raised questions about the names of the judges included in the bench and the initial remarks of the judges.

In a tweet, Gharidah Farooqi stressed the need for a full-court and said that the constitution has been violated in the country and the foundation of Pakistan is at stake. For derailing the system and democracy was attacked in broad daylight while only a full-court bench of the Supreme Court can take Pakistan out of this most serious crisis and guarantee the security of the Constitution of Pakistan for the future.

Farooqi continued to raise objections to the adjournment of the trials. In a tweet, Gharidah had criticised the adjournment of the hearing, saying that there is a constitutional crisis but the Supreme Court is adjourning the hearing till tomorrow. As if breaking the constitution is a normal thing for who will wait till tomorrow. The Supreme Court is the protector of the constitution but it let the Constitution and the people of Pakistan wait till tomorrow.

Senior court reporter Abdul Qayyum Siddiqui also gave an impression regarding judiciary blackmailing the opposition.

Senior journalist Hasnaat Malik also complained to the court about the slow trial of the case. He wrote in a tweet, “Another good day for PTI in CJP Bandial court: Every passing minute is going in favour of Imran Khan. Despite invoking suo motu jurisdiction, its seem that Supreme Court is conducting adversarial not inquisitorial proceedings in this matter.”

However, the landmark verdict has silenced the critics.
