Court orders to keep Shahbaz Gill at PIMS Hospital till Monday

The accused is suffering from asthma, the court orders Shahbaz Gill to submit his medical report again.

ISLAMABAD: The local court of Islamabad ordered Shahbaz Gill to be kept at PIMS Hospital until Monday, Judicial Magistrate Raja Farrukh Ali Khan pronounced the safe decision.

The court also ordered Shehbaz Gul to undergo medical again. The court declared that Shehbaz Gul is suffering from asthma and should be tested. The court ordered Shahbaz Gul to submit the medical report again by Monday.

The Chief of Staff of the Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan was produced in the District Sessions Court in Islamabad kachehri this morning. Gill was brought to the court with an oxygen mask on a wheelchair.

On the occasion of appearing before the court, Shahbaz Gill burst into tears. Gill said, “My mask is snatched away, give me the oxygen mask, they have been giving me these injections till two o’clock in the night, give me my mask.”

The magistrate inquired, “You want to stay at the court?” He said, “Give me a mask. I am an asthmatic patient and I need oxygen badly. Shahbaz Gul started running into the courtroom, on which the gas cylinder was brought there.

The police requested the court to remand the accused for another 8 days. The court inquired that the physical remand was given for two days before, why did you bring the request for 8 days? Why are you asking for an 8-day physical remand of Shehbaz Gill? The court remarked that technically the 48-hour physical remand has not started yet.

His lawyer Faisal Chaudhry said that according to the order of the Additional Sessions Judge, the 48-hour remand has been completed, now if he wants to take it again, he can request it. Shahbaz Gill’s illness is a genuine issue. Even from the medical report, it looks like he was tortured. I asked the doctor yesterday and he told me that doctors say that when someone complains of pain, they judge by looking at the fingers. According to this, the police are also believing that the remand has been completed.

Faisal Chaudhry added in arguments that there was an investigation in the hospital as well because we were allowed to meet as a lawyer at nine o’clock last night, on Monday this case is also pending in the High Court, there is no doubt that 48 hours have been completed. In front of you, the accused has been presented in a wheelchair with an oxygen cylinder, if Gill is given physical remand, then I think there is a life threat for him.

On this occasion, Advocate Faisal Chaudhry read yesterday’s order of the Acting Chief Justice of the Islamabad High Court (IHC). He said that the prosecution had given a brief till Monday that they would keep Shehbaz Gill in the hospital till Monday.

The judge said that I have to see the order of the Additional Sessions Judge. On this occasion, Shahbaz Gill said that my original report is not what he has presented. The court ordered the original report. Let it be known that this is their permanent illness.

The special prosecutor said in his arguments that when the accused was admitted, he was medically examined, the investigating officer asked for permission in the hospital yesterday but the hospital administration did not give permission, to that extent the health of the accused is not an issue. Everyone has the right to life. It is the responsibility of the investigating officer to ensure that, even without a court order, the investigating officer can conduct an emergency medical examination. It is not written anywhere that physical remand cannot be given if someone is ill. Even if physical remand is given, it is the responsibility of the investigating officer to take care of the health of the accused.

Special prosecutor Rizwan Abbasi said that yesterday the medical officer of Adiala Jail told the High Court that the accused made a complaint at 4 o’clock on the same day as the physical remand was ordered. The jail doctor was also present in the High Court. Rizwan Abbasi said that the jail doctor told the court that when the accused came to us, at that time the accused had no problem and the report was normal.

Gill’s lawyer intervened and said that the jail doctor did not say anything like that, on this the special prosecutor said let me talk, don’t do that. The judicial magistrate directed the prosecutor to continue talking to Faisal Chaudhry later.

Faisal Chaudhry said that it is accepted that the investigating officer was given the custody of Shahbaz Gul from Adiala Jail, there is no need for an injunction from the High Court because the court has said that it will hear on merit on Monday, from Shahbaz Gill’s lungs. The related medical report has not been presented, if you allow, the medical history of Shahbaz Gill can also be presented before the court.

On this occasion, the Judicial Magistrate instructed the lawyers to move back from the rostrum to see Gill and said, “Where is the poor man, Let me see him.” Later, the court reserved its decision and said that the decision will be given in half an hour.

The court allowed Gill’s two lawyers to meet him. On this occasion, Shahbaz Gill asked permission to speak to the judge. He said that I have undergone the medical test in America too, I know about this test. There has been only one report, there is no mention of the original report being hidden.

Judicial Magistrate Raja Farrukh Ali Khan gave a safe verdict to Shahbaz Gul after a break and ordered Shahbaz Gill to be kept in PIMs until Monday. The court declared that Shahbaz Gill is suffering from asthma and he should be tested. The court also ordered Gill to submit his medical report again by Monday.
