In the written decision of Monday’s hearing, the Supreme Court has asked three important questions.

1-Does the Election Commission of Pakistan have the authority to change the schedule?

2- Can the election be postponed for such a long time?

3- What will be the constitutional status of the caretaker government? If the elections are postponed, then the caretaker government will continue with it.

Along with this, the Chief Justice has also expressed his concern regarding the current enmity, enmity and bitterness. According to the Chief Justice, there is a smell of enmity in our politics. Chief Justice Umar Atta Bandyal made this observation while chairing a five-member bench of the Supreme Court, which heard PTI’s petitions against postponing the Punjab Assembly elections till October 8.

A 5-member larger bench headed by Chief Justice of Pakistan Justice Umar Atta Bandial heard the case. The Supreme Court has issued notices to the Federation, Khyber Pakhtunkhwa, Punjab, governors of both provinces and the Election Commission of Pakistan and sought their response by tomorrow. Chief Justice Omar Atta Bandial said that the court will hear the case on a daily basis.

During the hearing, PTI’s lawyer Barrister Ali Zafar said that it is an important constitutional matter that there is a delay regarding the elections in Punjab and Khyber Pakhtunkhwa.

Barrister Zafar Ali said that three basic orders are being violated. By postponing the elections, the Constitution of Pakistan is being violated, the orders of the Supreme Court of Pakistan on March 1 are being violated, the announcement of the election date by the President of Pakistan is being violated.

Therefore, we request the Supreme Court of Pakistan to implement its orders from the Election Commission. And make it possible to hold elections in Punjab and KP on April 30.

On this occasion, Justice Jamal Khan Mandukhel said that if you want the order to be implemented, then the best form for this is the High Court. Why did you come directly to the Supreme Court?

On this occasion, the Chief Justice of Pakistan said that this is an important constitutional and legal issue, it is a matter of fundamental rights of the citizens of both the provinces. So in this the court has to decide, whether this matter is to be decided by the Supreme Court, whether it has to hear this case or by the High Court.

Justice Ejazul Hasan remarked that the Election Commission of Pakistan had given the date after consultation with the President.
