Legal experts say Deputy Speaker Punjab Assembly Sardar Dost Muhammad Mazari has misinterpreted the decision given by the Supreme Court (SC) on Article 63A.
Hamza Shahbaz Sharif has taken the oath as Chief Minister Punjab. Governor Punjab Balighur Rehman administered the oath to Hamza Sharif.
According to the rules, Chief Secretary Punjab Sardar Ali Khan requested Governor Punjab Balighur Rehman to take oath as Chief Minister Punjab from Hamza Shahbaz.
The last meeting of the Punjab Assembly began under the chairmanship of Deputy Speaker Punjab Assembly Sardar Dost Muhammad Khosa. The meeting was called for the Chief Minister’s elections on the order of the Supreme Court. After the entire day’s conflict, the meeting began three hours late.
When the voting process was completed, Pakistan Tehreek -e -Insaf candidate Chaudhry Pervez Elahi got 186 votes while Hamza Shahbaz Sharif, the coalition candidate, got 179 votes.
Deputy Speaker Dost Muhammad Mazari declared the result and declared Hamza Shahbaz the winner, saying that all 10 votes of Q -League were rejected in the light of party chief Chaudhry Shujaat Hussain’s letter, ten votes were rejected. Hamza Shahbaz has won 3 votes, so Hamza Shahbaz Sharif will remain the Chief Minister.
Legal experts say that Deputy Speaker Dost Muhammad Mazari has misinterpreted the Supreme Court orders, which can lead to a new political and legal crisis.
Renowned lawmaker Salman Akram Raja wrote on social networking websites Twitter, saying that the party chief cannot stop members of the parliamentary party from voting against the parliamentary party’s decision. He wrote that Article 63A is very clear in this regard.

Sameer Khosa wrote on his Twitter account that “referring to the Supreme Court order, people have said that the vote cannot be cast contrary to the directions of the parliamentary party chief.”

He further wrote that two separate terms could not be presented in 63A regarding the party chief. The Supreme Court was not divided into parts. The decision given is not in accordance with the Supreme Court order.
Legal experts say that the deputy speaker misrepresented the Supreme Court’s decision and which has given rise to a new political crisis in the country.
Legal experts say a petition has been filed against the Deputy Speaker’s decision and as far as the interpretation of Article 63A is concerned, it is possible that the Supreme Court will roll out the rolling of Sardar Dost Muhammad Mazari.
