Muftis of Jamia Naimiyyah Lahore, country’s leading religious school, issued a fatwa and declared Toshakhana law against shariah.
Scholars have appealed to the Chief Justice to take notice of the change in the Tosha Law and said that taking the goods of the Tosha Khana at a low price is a betrayal of trust in the Islamic sense, the gifts of the Tosha Khana are the trust of the nation and the nation, the gifts should be used for public welfare. Spending should be on welfare.
On Monday, the four muftis of Jamia Naimiyya, Dr. Mufti Raghib Naimi, Mufti Imran Hanafi, Mufti Nadeem Qamar and Mufti Arif Hussain, said in a joint fatwa that “Taking the items of Tosha Khana at a low price is a betrayal of trust in Shari’a terms. The gifts are the trust of the nation and the nation, the gifts should be spent on public welfare.

It has been said in the fatwa that “buying gifts at a lower price than the coffin is tantamount to breach of public trust”. Help change the law on gifts for personal use.
The scholars also cited a number of hadiths that discourage the use of gifts by government officials. The fatwa said that according to the blessed hadiths, gifts received by government officials will be deposited in the state treasury. But the Messenger of Allah (ﷺ) has warned about keeping the gift received by a wealthy person.
It should be noted that two days ago, about 21 years of records of Tosha Khana were made public by the federal government. The record of Tosha Khana from 2002 to 2023 has been uploaded on the website of Cabinet Division. A record of 466 pages related to Tosha Khana has been uploaded on the website.
