National Assembly violated constitution by passing resolution against Supreme Court

There will be no debate in Parliament regarding performance of duties of a judge of Supreme Court or High Court, sword of contempt of court has been hanged on members of parliment House for violating Article 68

National Assembly committed a violation of the constitution by passing a resolution against decision of Supreme Court regarding holding of elections in Punjab.

Article 68 of Constitution obliges National Assembly not to discuss conduct of High Judiciary.

Yesterday, the government passed the resolution of the National Assembly to reject the decision of the 3-member bench of the Supreme Court regarding the holding of elections in Punjab.

In the resolution, instead of a three-member bench, the case has been demanded to be heard in a full court. It has been said in the resolution that the House expresses its concern over the undue judicial interference in political matters, the recent minority decision is creating political instability in the country, the way of division into federal units has been paved, and this House has upheld the three-member minority decision. Rejects and binds the Prime Minister not to implement the decision.

The resolution states that the House considers general elections as a solution to the problems at the same time for political and economic stability. The House rejects the minority decision of the three-member bench. Expresses serious concern over rewriting by judgment. The resolution has demanded that the full court of the Supreme Court review it.

However, by passing a condemnation resolution against the 3-member bench of Supreme Court, government has been found guilty of violating the constitution. Article 68 of Constitution binds National Assembly that there shall be no debate in Parliament regarding the performance of duties of a Judge of Supreme Court or High Court.

Now it is to be seen whether the Supreme Court will proceed with contempt of court for the clear violation of the Constitution or try to reduce the political temperature by using amnesty and mercy.
