It is unconstitutional under Section 1 of Article 82 to present a resolution on election expenses in the National Assembly contrary to the orders of the Supreme Court of Pakistan (SCP).
Supreme Court issued an order to Ministry of Finance regarding the expenses of the general elections in Punjab, but the Minister of Finance submitted the resolution in the National Assembly against the court order and the constitution.
Supreme Court had ordered on April 4 that Federation should give 21 billion rupees to the Election Commission under Federal Consolidated Fund by April 10. The Election Commission will submit a report on the amount to the Supreme Court on April 21.
Under Article 82 Section 1 of the Constitution, the Federal Consolidated Fund does not require the approval of Paliman, however, expenditure resolution was presented to the National Assembly.
According to Prime Minister Nazir Tarar, the matter related to the provision of funds to Election Commission has been sent to the Parliament. National Assembly will decide on it.
On the other hand, National Assembly has passed a resolution to hold simultaneous elections across the country against the order of the Supreme Court.
The text of the resolution states that the House believes that economic stability is not possible without political stability. In the opinion of this House, under Article 218 of the Constitution, all provincial and national assembly elections should be held simultaneously in the form of general elections throughout the country. It is necessary.
It should be remembered that the Supreme Court in a decision of April 4 ordered the government to hold general elections in Punjab by May 14.
