Salman Akram Raja gives reason why PTI cannot be banned

Senior lawyer gave the reason why PTI could not be banned after the ECP's verdict on the prohibited funding case.

Senior lawyer Salman Akram Raja has given the reason why Pakistan Tehreek-e-Insaf (PTI) could not be banned after the Election Commission of Pakistan’s (ECP) verdict on the prohibited funding case.

He wrote on Twitter, “Section 6(3) of the PPO 02 did not prohibit the taking of funds from foreign nationals. However, reading Sections 2(c)iii, 15 with Article 17(2) of the Constitution means that if funds from foreign nationals make a party work against the sovereignty & integrity of Pakistan it may be dissolved.”

In another tweet, Salman Akram Raja said, “Dissolution of a political party with roots in the people is always a national setback. The nation suffered when NAP [National Action Plan] was dissolved in 1975. The space was filled with religio-fanstacism. Constitution allows dissolution only when a party is against the sovereignty/integrity of the country.”

The coalition government has reportedly planned to launch crackdowns against PTI leaders following the verdict announced by the Election Commission of Pakistan (ECP) in the prohibited funding case besides mulling over the inclusion of Imran Khan’s name in the Exit Control List (ECL).

According to reports, the coalition government planned to launch crackdowns against Imran Khan’s close aides and PTI’s central and provincial leaders across the country through the Federal Investigation Agency (FIA) and other concerned institutions under the 12-point charge sheet of the ECP.

It was learnt that the government’s machinery will swing into action across the country after getting a green signal from the Centre. Some reports suggested that PTI’s secretariat employees and central finance board members will also be probed in the coming days.

Moreover, the Centre will also approach the Supreme Court (SC) for disqualification of PTI chief and former premier Imran Khan in light of the ECP verdict.

In its verdict, the ECP said that PTI received prohibited funds and the political party failed to disclose 13 of its bank accounts.
