Sou moto is not mentioned anywhere in Constitution of Pakistan, Justice Qazi Faez Isa

Justice Qazi Faez Isa, most senior judge of the Supreme Court of Pakistan, has said that 184 (3) has been used extensively in Pakistan, 184 (3) is called suo moto in constitution, there is no word suo moto in the constitution, and If you go to England, they won’t even know what Suo moto is.

These views were expressed by Justice Qazi Faez Isa while addressing the event organized on the theme of “Pakistan National Unity Constitution”. It keeps repeating, if a decision is wrong, it remains wrong even if all the judges decide.

Referring to dictators, Justice Qazi Faez Isa said that a dictator comes to us and then starts deceiving himself for some time, Pakistan broke up in December 1971, it did not break suddenly but seeds were sown. The main reason for the breakup of Pakistan was the wrong judicial decision, Justice Munir in the Federal Court sowed the seeds of breaking up Pakistan. The seed that was sown split the country in two.

Justice Qazi Faez Isa said that on July 4, 1977, a civil servant attacked democracy and the constitution. Martial law was lifted from the country on December 30, 1985, the man ruled for 11 years, then died in a plane crash.

Referring to Pervez Musharraf, Justice Qazi Faez Isa said that on October 12, 1999, a civil servant thought that there could not be a better man than me, and he seized power. Musharraf himself gave himself constitutional protection, Musharraf made a second attack on the constitution on 3 November 2007.

Qazi Faez Isa said that automatic notice cannot be used to benefit anyone. Only the Supreme Court has the authority to take notice automatically. 184 (3) the Supreme Court automatically becomes a trial court after taking notice.

Justice Qazi Faez Isa, while presenting his explanation, said that since he became a judge of the Supreme Court, he never expressed his likes and dislikes. Never recommended sitting or not sitting on any bench.

He said that the Constitution was never presented in the way it deserved.
