LHC orders ECP to conduct elections in Punjab in any case within 90 days

The Lahore High Court ordered Election Commission of Pakistan (ECP) to hold elections in Punjab province within 90 days.
According to the details, the Lahore High Court ordered the Election Commission of Pakistan to conduct the elections in Punjab within 90 days. The decision of the Lahore High Court consists of 16 pages.
Lahore High Court announced the reserved decision on the request of Pakistan Tehreek-e-Insaaf for the date of election in Punjab. According to the decision, the court directed the Election Commission to announce the election.

Justice Jawad Hassan of Lahore High Court reserved the decision while hearing the petitions of Tehreek-e-Insaf and citizen Munir Ahmed.
During the hearing, the lawyer of the Election Commission said that there is no scope in the constitution to give a date on behalf of the President or the Election Commission.
The governor’s lawyer said that the assembly was not dissolved by the governor, so it is not his responsibility to give the date.
The lawyer of the Election Commission said that it is not the job of the Election Commission to give the date of the elections. Elections cannot be held until funds are provided to the commission. Provincial assembly elections require the full cooperation of the federal government. In certain circumstances, the law allows for postponing elections.

If the National and Provincial Assembly elections are not held on the same day, the transparency of the elections may be affected.
Advocacy Shahzad Shaukat, the lawyer of Punjab Governor, said that the Governor did not dissolve the Punjab Assembly. Therefore, it is not their responsibility to give the date of new elections.
The Governor’s counsel had pleaded for dismissal of the petition as inadmissible.
Tehreek-e-Insaaf’s lawyer Barrister Ali Zafar had taken a stand that if the governor does not give the date of the election, then the president can fix the date. It cannot be kept silent.
At the beginning of the hearing, the IG Punjab and the Chief Secretary had assured the court that the decision of the Election Commission would be fully implemented.
