Advocate General’s letter to Commissioner to include Rana Shamim’s name in ECL

Earlier, advocate Rai Muhammad Nawaz Kharal had moved Islamabad High Court seeking inclusion of Rana Muhammad Shamim's name in ECL.

Advocate General Islamabad Niazullah Niazi has written a letter to the Chief Commissioner Islamabad to include the name of former Chief Justice Gilgit-Baltistan in the ECL.

In a letter written by Advocate General Niazullah Niazi, it has been stated that Rana Shamim is facing a contempt of court case, therefore proceedings should be initiated to include his name in the ECL.

The letter said that Rana Mohammad Shamim’s departure abroad would have serious implications for the case, so immediate action was required to include his name in the ECL.

It may be recalled that earlier, in view of the fear of former Chief Justice Gilgit-Baltistan Rana Shamim fleeing abroad, Advocate Rai Muhammad Nawaz Kharal had filed an application to become a party in the contempt of court case.

Advocate Rai Muhammad Nawaz Kharal had taken a stand in his petition that Rana Shamim should remain an official of PML-N in Sindh. Advocate Rai Muhammad Nawaz Kharal said that it is feared that Rana Shamim may not flee abroad, so the court should order the Interior Ministry to include Rana Shamim’s name in the ECL.

However, the Chief Justice of the Islamabad High Court, Athar Minallah, in his remarks, had said that the contempt proceedings were aimed only at the public interest and the contempt case was specifically between an alleged contender and the court.

Chief Justice Athar Minallah has written in his judgment that no person other than an alleged contender can claim to be a necessary party for contempt proceedings. The court dismissed the petition as inadmissible.
