Article 63-A cases: PML-N, PDM allies to file petition for SC full bench
PML-N government and PDM allies will file a petition in SC today for the formation of a full court bench to hear Article 53-A-related cases.
ISLAMABAD: The Pakistan Muslim League Nawaz (PML-N) government and its Pakistan Democratic Movement (PDM) partners will file a petition in the Supreme Court today for the formation of a full court bench to hear cases related to the interpretation of Article 63-A.
The development came after the top court curtailed the powers of Punjab CM Hamza Shehbaz as a trustee chief minister as the SC Lahore Registry will resume the hearing of a petition against the PA deputy speaker’s ruling on Monday after giving an interim verdict.
On Saturday, the interim verdict had been announced by a three-member SC bench comprising Chief Justice of Pakistan (CJP) Umar Ata Bandial, Justice Ijazul Ahsan and Justice Munib Akhter regarding Punjab CM candidate Pervaiz Elahi’s petition against the deputy speaker’s ruling during the CM election.
The government’s petition will be filed after Punjab Assembly Deputy Speaker Dost Muhammad Mazari rejected to count Pakistan Muslim League Quaid (PML-Q) votes in Chief Minister (CM) election.

The government leaders along with PDM politicians also addressed a press conference at 10:30 am on Monday.
The leaders are likely to go to the top court along with their lawyers to file the petition for the formation of a full court bench to jointly hear the cases related to the CM Punjab election, the review petition of the Supreme Court Bar Association’s (SCBA) for the interpretation of Article 63-A and other related petitions.
Following the developments, Pakistan Tehreek-e-Insaf (PTI) central leader Fawad Chaudhry said it was a prerogative of the chief justice to form a full court bench, however, there was no room for legal interpretation of Article 63-A anymore.

In a press conference along with PDM leaders today, PML-N Vice-President Maryam Nawaz has said that if the decisions are right, criticism has no meaning and the country will go in the right directions. ‘A monitoring judge is always there in any case against us,” she alleged.
While strongly criticising the Supreme Court (SC), Maryam Nawaz said that bench fixing is being done in the same way as match-fixing is being done. She added there should be suo motu on bench fixing. Maryam said that the people are outraged due to the decisions of a few judges.
Maryam Nawaz said that in 2014, there were arson attacks, civil disobedience and violent attacks on PTV were carried out and the top court was disrespected, but no action was taken.

Criticizing Imran Khan, Maryam Nawaz said that no court is allowed to take suo motu notice against Imran Khan. If there is a comparison, it will be Nawaz Sharif government and Imran Khan government, after 2017, such a country is not able to handle the shock anymore.
He said that when I was coming here to hold a press conference, it was said that you should not hold a press conference today because your Panama case is going on in the High Court and its decision is about to come, so call your press conference today. The case should not be affected, lest you be disqualified. My answer was that those who are representatives of the people have to think beyond themselves.
