A 9-member larger bench of the Supreme Court was hearing constitutional petitions related to the controversial memogate given to former US military chief Admiral Mike Mullen by Hussain Haqqani.
The bench headed by the Chief Justice included Justice Mian Shakirullah Jan, Justice Jawad S Khawaja, Khalji Arif Hussain, Tariq Parvez, Asif Saeed Khan Khosa, Ameer Hani Muslim, Justice Ejaz Ahmad Chaudhry, and Azmat Saeed.
During the hearing, Hussain Haqqani’s lawyer Asma Jahangir said that hearing without issuing a notice is illegal.
The court again issued notice to all the parties of the case and ordered that Hussain Haqqani appear at the next hearing.
The court also ordered to make of the memo commission report public.
During the hearing, Chief Justice Iftikhar Muhammad said that the court will analyze the report and determine what facts are stated in it and how much truth is in them.
While issuing notice to the parties in the case again, the court adjourned the hearing of the case for two weeks.
Earlier, a three-member inquiry commission headed by Justice Qazi Faiz Isa had submitted its report on the memo commission to the Supreme Court. The report said that the memo was indeed genuine and was written by the former ambassador.
Renowned journalist and analyst Hamid Mir wrote on his Twitter handle about the reality of Memogate “Former DGISI General (Rtd) Shuja Pasha also apologized to Asif Ali Zardari on the Memogate scandal, and said It was that I did everything at the behest of General Kayani.”
The report of the commission said that Haqqani had forgotten that he was Pakistan’s ambassador to the US.
The report further stated that Hussain Haqqani violated the country’s constitution.
The report said that while Hussain Haqqani was receiving a salary from the government of Pakistan, his loyalties were not with Pakistan.
The commission said in its report that the former ambassador decided not to stay in Pakistan, adding that Hussain Haqqani neither owned any property in the country nor had any bank balance.
The Commission further wrote in its report that the purpose of writing the memo was to convince the US authorities that the civilian government of Pakistan was friendly to the US and that only the civilian setup could control Pakistan’s nuclear program.
The report also said that through the memo, Haqqani wanted to convince the US to form a new security team and that he himself wanted to head the team.
Analysts say that during this period, General Ashfaq Parvez Kayani had set up Memogate scandal through Shuja Pasha and Faiz Isa Sahib acted as his pawn.
