In a statement issued by the ruling coalition Pakistan Democratic Movement, it has been said that it rejects the move of the Supreme Court to form a controversial bench.
The statement said that the bench which was constituted was constituted in haste, and the priorities of this bench are against justice and fairness. The statement said that the Pakistan Bar Council’s statement is proof that this move is against justice, prevailing judicial procedures and established principles.
The statement said that on October 12, 2019, the All Pakistan Lawyers Convention in Lahore passed a resolution that the Supreme Court Practice and Procedure Bill should be approved by the Parliament. The declaration said that any interference in the power of the Parliament will be strongly resisted. It has been said in the declaration that there will be no compromise on the authority of the Parliament in the light of the Constitution of Pakistan.
Prime Minister Nazir Tarar, while addressing a joint press conference after issuing a declaration by the ruling coalition, said that an 8-member bench of the Supreme Court was formed hastily, the bill approved by the Parliament and the Senate was sent back by the President. The bill was not passed and an 8-member bench was constituted.
Azam Nazir Tarar said that the bill is about the power to create a bench, which is not yet a law, but he agreed that you have created a bench on it, according to all traditions and principles of propriety. The Chief Justice himself should not head this bench, because there is a conflict of interests, the bar councils and bar associations demanded that a law should be made regarding his powers. Bar councils across Pakistan have rejected the constituted bench.
Azam Nazir Tarar said that the Pakistan Bar Councils have said that this issue should not be made a problem of ego. Despite all these things, the direction in which things are going, will create a situation of conflict. The Parliament has the power under the constitution and law to enact legislation for the betterment of the people of Pakistan, for the strengthening of the institutions, keeping in view the importance of the institutions, to insure their impartiality.
