SC Practice and Procedure Bill 2023 challenged in two Highest Courts in a single day

Application against bill has been filed in Supreme Court by Advocate Muhammad Shafi, while this bill has been challenged in Islamabad High Court by Advocate Saad Aftab

After Lahore High Court, “Supreme Court Practice and Procedure Bill 2023” has been challenged in Islamabad High Court and Supreme Court.

According to details, Supreme Court Practice and Procedure Bill 2023 passed by federal government has been challenged in the Islamabad High Court and Supreme Court.

A petition against Supreme Court Practice and Procedure Bill 2023 has been filed in Islamabad High Court by lawyer Saad Aftab. In petition, the position has been taken that Supreme Court Practice and Procedure Bill, 2023 should be declared null and void.

It is further contended in petition filed that main demand was only for appeal against Article 184(3) decisions.

It has been requested in the petition that the right of intra-court appeal can be given to Supreme Court on High Court style.

On the other hand, in the petition filed in the Supreme Court, it has been requested that the Supreme Court Practice and Procedure Bill 2023 should be declared illegal.

It was said in the petition that only the Supreme Court has the authority to make the rules of the Supreme Court. This petition has been filed under Article 184(3) of the Constitution.

The petition has been filed in the Supreme Court by Muhammad Shafi, a lawyer of the Lahore High Court. The petition states that the Supreme Court Practice and Procedure Bill 2023 passed by Parliament is illegal. It should be declared illegal and unconstitutional.

Secretary Law, Secretary Senate and Secretary National Assembly have been made parties in the petition. The petition states that there can be no control over the judiciary by the executives. Because the judiciary is an independent institution.
